Property
When a relationship ends, the property pool usually includes the home, superannuation, savings, debts, vehicles and any business interests. It doesn't matter whose name is on the title. The goal is a fair division based on contributions and future needs.
Parenting arrangements
The law focuses on what is in the best interests of the children. Most parents end up with a written routine that covers where children live, time with each parent, and how decisions are made. Court is rarely needed.
Time limits
For married couples, you generally have 12 months from the date your divorce becomes final to lodge a property claim. For de facto couples, the window is 2 years from separation. You can agree outside these deadlines, but the formal claim clock is ticking.
Consent orders
An agreement you reach together can be made binding through consent orders. This means the deal is enforceable and final, without anyone having to go to a hearing. It's the most common way family law matters resolve.
